Content of distraint order

A specifically appointed judge decides over applications for distraint orders in a summary procedure. There is no hearing of the opponent and neither is any evidence collected (such as witness statements). The ruling is made in favour of the creditor if the judge decides the case put forward is convincing. If the judge decides in favour of a distraint order, he issues a distraint order warrant.
